Terms & Conditions – “Monsoon BONANZA”

1. To participate in the Contest, SMS <WIN> to 57272.
2. The Contest is open only to Indian citizens (individuals) residing in India aged 18 years or above, who are valid subscribers of Tata Teleservices Ltd (TTSL) or Tata Teleservices (Maharashtra) Limited (TTML) (TTSL and TTML hereinafter collectively referred to as “TTL”).
3. Subscriber to the telecommunication services of TTL and participant in the Contest hereinafter referred to as the “Subscriber/s”.
4. The Contest is neither open for employees, distributors, franchisees, agents and suppliers of TTL and J9 Mobile nor for the relatives of such employees, distributors, franchisees, agents, vendors and suppliers of TTL and J9 Mobile.
5. The Contest shall run from a period of 45 days starting from 15th July 2010 and ending on 31st August 2010 at 0000 hrs in the night (hereinafter referred as “Contest Period”).
6. The Contest is valid only in India.
7. The Contest will be in the form of 10 different questions daily to be answered correctly by the Subscriber, the Subscriber having the maximum number of correct answers will attain the maximum score. The questions will be based on different topics like General Knowledge, Politics, History etc specific to a particular telecom circle on the basis of mobile number series. Every correct answer will carry 10 points. Subscriber scoring maximum points during the Contest Period will be eligible for the Prize/s. Gratifications will be as follows:

Subscriber scoring maximum score at the end of the Contest Period will be the winner of the Contest and will be winner of a Grand Prize of  1 Maruti Zen Estillo car (Ex-Showroom prize of  Rs.3,21,000/-, of DELHI.) Any difference in ex-showroom prize or delivery charges will be borne by the subscriber.
9. One Subscriber scoring maximum score subsequent to the winner of the Contest will be the 1st Runner Up of the Contest and will win 1st Runner Up cash prize of  Rs.25,000/-
10. One Subscriber scoring maximum score subsequent to the 1st Runner Up of the Contest will be the 2nd Runner Up and will win a 2nd Runner Up cash prize of Rs.15,000/- .
11. One Subscriber scoring maximum score subsequent to the 2nd Runner Up of the Contest will be the 3rd Runner Up and will win a 3rd Runner Up cash prize: Rs.10,000/- .
12. One Subscriber scoring maximum score at the end of each Week Period during the Contest Period will win a Weekly Cash Prize of Rs.10000/-.  (“Week Period comprise of one week of 7 days starting from Monday at 00.01 hrs in the morning till Sunday at 00.00 hrs in night”)
13. The Contest shall be open till 0000 hrs in night, during each day of the Contest Period.
14. The prize/s to the Subscribers is in the interest of the Subscribers. Since service is a premium service, the access charges for prepaid & postpaid Subscribers on SMS short code 57272 shall be Rs. 3 per SMS. The charges paid by the Subscribers are towards the service and no additional charge will be collected from the Subscribers for participation in the Contest.
15. The Contest is organized by TTL for their Subscribers and managed by J9 Mobile. The Subscribers understand that the prize/s under the Contest are provided by J9 Mobile and TTL shall not be responsible for non-delivery or shortfall or deficiency in prize/s and all the legal remedies in relation to the prize/s solely lie against J9 Mobile.
16. In case there are two or more Subscriber with the same score, then the winner will be the one who has scored the maximum score earliest amongst the two or more Subscribers as per TTL records. The decision of TTL shall be final and binding on all the Subscribers of the Contest. TTL shall entertain no dispute in this respect.
17. The winner/s shall be intimated within 45 days of conclusion of Contest by J9 Mobile by way of telephonic call and SMS, on confirmation of the list of winners by TTL.
18. In the event of no response from the concerned winner to the telephonic call or SMS within 10 days of intimation by J9 Mobile, he will be intimated through a registered post. If the concerned winner does not respond to the registered post communication within 10 days of the receipt of the post or if the registered post returns undelivered then his prize/s will be forfeited.
19. The prize/s will be distributed within 45 days from the acknowledgement of the acceptance of the prize/s by the concerned winner in response to the communication from J9 Mobile. If the winner absents from taking the delivery of the prize/s and fails to collect the same from TTL within 75 days from the acknowledgement of the acceptance of the prize/s by him, then his prize/s stands forfeited.
20. The prize/s will be distributed and delivered by J9 Mobile through courier at the address of the winner, as appearing in the records of TTL. The Logistics and cost of delivering the prize/s will be borne by J9 Mobile. It is the responsibility of the Subscriber to inform TTL of any change in the address of communication, as appearing in the records of TTL. In the event of the winner responding that he/she has changed the address of communication, the winner should submit proof of address change to TTL for the proper delivery of prize/s.
21. Prize/s is/are non-endorsable, not transferable and non-substitutable.
22. J9 Mobile will entertain no requests for exchange in lieu of the prize/s.
23.  The prize/s for the Contest will be given only to the winner/s in whose name the mobile phone number is registered. The winner needs to be the TTL active subscriber at the time of receipt of prize/s and winner should have cleared all the outstanding dues of TTL.
24. Apart from the entitlement to the above prize/s, the winner/s or their legal heirs will have no other rights or claims against J9 Mobile.
25. TTL reserves the right to terminate, modify or extend this Contest at any time at its absolute discretion, with notice to the Subscriber.
26. The Contest cannot be clubbed with any other Contest.
27. The prize/s shall be subject to the laws of India, including all the tax laws. All applicable regulatory and statutory duties, cess, surcharges, taxes (including TDS), insurances, transfer fees, registration fees etc. that may be applicable to avail/use the prize/s will be borne by the winner.
28. TTL and J9 Mobile shall not be liable for any failure to comply with its obligations caused by weather conditions, fire, flood, strike, hurricane, industrial dispute, war, hostilities, political unrest, riots, civil commotion, terrorist attack, inevitable accidents, acts of god or any other circumstances amounting to Force Majeure.
29. TTL and J9 Mobile shall not be responsible for any loss or damage if it has to discontinue or cancel this Contest in compliance with any law, ruling, order, regulation, circular, notification, requirement or instruction of any Central/State Government or for any other unavoidable reason beyond its control. The Subscriber shall be informed of such discontinuance/cancellation as soon as possible, through the Tata Docomo website.
30. The participation in this Contest implies unconditional acceptance of all the terms and conditions of the Contest by the Subscriber.
31. The decision of TTL as to the interpretation of any of these terms and conditions shall be final and binding on the Subscriber/s.
32. Any disputes with regard to the Contest, will be subject only to the jurisdiction of the courts in Mumbai.
33. The aggregate liability of J9 Mobile, in case of any damage, loss, cost, claim, liability or expense (including legal costs and expenses) caused to or incurred by any act, omission or representation in respect of the Weekly prize/s, Runner Up prize or the Grand Prize of this Contest to any individual winner, shall not exceed the value of the Weekly prize/s, Runner up Prize or Grand Prize as the case may be.
