Terms and Conditions – Reverse Gear 2009

1. These Terms of Use govern your participation in the Reverse Gear. “You” (the user) agree to abide by the terms and conditions as set out here.
2. Your entering the said Reverse Gear shall be deemed as your acceptance of the terms and conditions.
3. This Reverse Gear is solely for Indian citizens above the age of 18 years residing in India
4. You expressly agree and acknowledge that the participation in the Reverse Gear is at your sole risk and responsibility. The Reverse Gear is provided on an ‘As Is' and ‘As Available' basis.
5. Participant/ owner of a mobile phone through which the bid has been placed will be responsible for all/ any action that has been initiated/ completed through their mobile phones.
6. Participants SMS to J9 in regards to participation in the Reverse Gear will be treated as an electronic communication and we will assume that you have also given us a consent to receive communication from us electronically on the same mobile phone.J9 expressly disclaims all warranties of any kind, whether express or implied. Neither does J9 make any warranty that the services will meet your requirements, or the services will be uninterrupted, timely, secure, or error-free; nor does J9 make any warranty as to the results that may be obtained through the service or that defects in the software will be corrected. J9 reserves the right to stop the Reverse Gear at any time and/or change, modify, withdraw, or extend the Reverse Gear without any prior notice and no correspondence in this regard shall be entertained. J9 reserves the right to withdraw/change / modify the content and terms and conditions at its own discretion and without any prior notice and / or assigning any reason. Therefore, you are advised to regularly check for any amendment(s) or update(s) of the terms and conditions. J9 reserves the right to withdraw from the Reverse Gear at its own discretion and without any prior notice and / or assigning any reason. In case J9 is withdrawing Reverse Gear, J9 is only liable to give the winners gratifications as won by them during the time Reverse Gear was running. This Reverse Gear is open to the users on Sms platform. To participate through Sms a user has to send 'BID' to 57272.
7. J9 and its partners are not responsible for any failure of systems/technology etc. as a result of which the bid does not reach the service/application of Reverse Gear.
8. Bid should be restricted to a maximum of two decimal places, Eg.: Rs.1.23. Any bid above two decimal points will be considered invalid, Eg.: Rs. 1.0001 and thus, it would be treated as invalid bid. Also a negative BID amount would be treated as INVALID, for e.g. -1.01 and thus would not be considered.
9. Successful bidder would be able to get the product only after correctly answering the obligatory question asked via SMS on his/her mobile phone within 24 hours from closure of bidding cycle; Successful bidder will be the one who is the owner of the mobile number from where the successful bid was originated.
10. The successful bidder will be required to submit a demand draft in favor of Jagran Prakashan Ltd payable at New Delhi, equal to the value of successful bid and take the sole responsibility of paying any/all taxes (gift tax/ income tax etc) as per applicable law and share the proof of tax submission in form of a receipt with J9 post which the product will be delivered within a maximum period of 90days.
11. The successful bidder would be communicated by our Customer Care Team for the disbursal of Prize. The successful bidder is required to submit documents for proof within 1month of Prize declaration. Any documents received after 1month would be discarded and the Winner would not be eligible for the Prize. The documents required are Address Proof, Identification Proof and two photographs and needs to be sent at Jagran Prakashan Limited, Plot No. 84, 2nd Floor, Okhla Phase 3, Modi Mill Compound, New Delhi-110020.
12. Any items or Prizes for more than Rs5000 would attract Tax as per the government Laws and would be borne by the Winner.
13. Successful bidder will be decided on the basis of lowest & unique bid submitted & processed at the close of the auction as per J9 server time(06:00:00 hrs to 05:59:59 hrs the next day for 24 hrs). This will be represented by way of a time-stamp mentioned along with successful bid confirmation messages. J9 time stamp (06:00:00 hrs to 05:59:59 hrs) will be the final & binding. J9 doesn’t take any responsibility for late or no delivery of bid status message to the subscriber due to delay or fault at mobile operator’s end.
14. J9 will try its best to ensure the product shown in communication (with features) is delivered to the successful bidder within a maximum period of 90 days. In case the same product is not available for reasons beyond J9’s control, a similar product of similar value will be given.
15. This Reverse Gear is not valid for employees, their respective family members or relatives of J9 and its affiliates.
16. In no event, J9 shall be responsible for non-receipt of the bid by J9 or non-delivery of out-bid message to any bidder by J9 due to operator network failure/congestion/any other reason.
17. J9 reserves the right to terminate/suspend/block the mobile number of the participant if found violating the terms & conditions or providing false information to J9.
18. Incase, the respective operator is not able to verify/ authenticate the information pertaining to a subscriber then J9 has the right to issue a warning/ terminate/ suspend access for the said participant to Reverse Gear.
19. J9 does not take responsibility of sponsor’s credentials, product feature claims. Participants would bid for the said product at their own risk.
20. J9 Mobile is powering "Time based BIDDING" - BIDDING opens everyday at 06:00:00 hrs to 05:59:59 hrs the next day for 24 hrs. The BIDDING can be done for 24hrs or for multiple of 24hrs of BIDDING cycle. The BIDDING process will open to subscribers from morning of 19th Jan`2010 i.e. 06:00:00 hrs.
21. BID received after the J9 server time(06:00:00 hrs to 05:59:59 hrs the next day for 24 hrs), would be considered null for the same day and product. The same BID would be considered for the next auction.
22. J9 Mobile reserves the right to Add or Modify gratification(s) anytime during the tenure of the Reverse Gear.
23. Reverse Bid is open to mobile subscribers of only Airtel UP East and UP West at Rs3/sms..
24. J9 or its directors / officers / affiliated companies will in no way be responsible for circumstances beyond its control, which hinder the completion of the Reverse Gear.
25. All disputes are to be settled under the exclusive jurisdiction of the courts at Delhi.
